Indemnização em caso de denúncia antecipada: O cumprimento integral da duração do Contrato é uma condição essencial para ao Property Manager, uma vez que o Preço acordado foi fixado tendo em consideração precisamente a duração da estadia contratada e tendo em atenção a dificuldade ou impossibilidade de comercializar a Unidade a partir da referida data, e mais ainda após o início do ano letivo. Em caso a resolução unilateral por parte do Residente, o Residente pagará ao Property Manager, como indemnização por danos, un montante equivalente às totalidades das Mensalidades até à Data de Fim do Contrato, com um máximo de três (3) Mensalidades. Além disso, se não tiverem decorrido três (3) meses desde a Data de início da Estadia, as Mensalidades pendentes de pagamento até esses três (3) meses desde a a Data de Início da Estadia serão adicionadas ao montante a pagar ao Property Manager. Não obstante o acima exposto, a indemnização a pagar ao Property Manager será o montante do Caucão pago em qualquer dos seguintes casos excepcionais, que devem ser prévia e devidamente documentados no prazo de cinco (5) dias de calendário da sua ocorrência pelo Residente: - Perda de visto do Residente estrangeiro no comunitário por causa que não lhe seja imputável. - Ter solicitado e não ter sido colocado numa instituição de ensino presencial na área metropolitana do Porto. As indemnizações anteriores acrescerão a quaisquer quantias devidas pelo Residente ao Property Manager, decorrentes de danos ou prejuízos causados, o Property Manager também pode tomar posse total da Mensualidade paga pelo mês em que o Residente pretende rescindir o Contrato. PENALIDADE POR CANCELAMENTO ANTECIPADO (caso o inquilino cancele a reserva antes da data determinada como final do contrato): - TERÁ QUE PAGAR O VALOR TOTAL DO CONTRATO For COLIFE properties: Termination of the Contract: The Agreement may terminate for any of the following causes: a. Departure Date of the Stay; b. By agreement of the Parties; c. By denunciation of one of the Parties pursuant to Clause 10 (Denunciation and termination of the contract) of the General Conditions; d. By resolution of the Agreement pursuant to Clause 10 of the General Conditions; e. By amending the conditions of admission or stay. Clause 10 - Denunciation and termination of the contract: 10.1 The Resident may terminate the Agreement by written communication, upon payment to the property manager of compensation corresponding to 25% of all Monthly Payments due up to the End of Stay Date. 10.2 Without prejudice to other rights arising out of the law or the Agreement, failure by either Party to its obligations gives the other Party the right to resolve it in accordance with the terms agreed in this Agreement. 10.3 The termination of the Agreement shall operate automatically on the date of receipt of a resolution notice and the immediate termination of any rights or obligations assumed by the Parties arising therefrom, except: a. Late payments or required adjustments; b. the obligation of confidentiality as set out in Annex III; c. The right to any compensation.
