Recesso e penali Il Cliente ha facoltà di recedere dal Contratto mediante comunicazione scritta da inviarsi con raccomandata con il preavviso previsto a seconda della durata del Contratto: (a) almeno 180 (centottanta) giorni prima del rilascio dell’Alloggio, per i Contratti di durata pari o superiore a 10 mesi; (b) almeno 90 (novanta) giorni prima del rilascio dell’Alloggio, per i Contratti di durata maggiore o uguale a sei mesi; (c) almeno 30 (trenta) giorni per i Contratti di durata inferiore a sei mesi. In caso di recesso, il Cliente verserà una penale per recesso anticipato. L’importo della penale è determinato come segue: (i) per soggiorni inferiori a 7 (sette) mesi, la penale è pari una rata mensile della Quota Alloggio come definita nel Contratto; (ii) per soggiorni pari o superiori a 7 (sette) mesi, la penale è pari a due rate mensilità della Quota Alloggio, come definita nel Contratto. Il Cliente dovrà inoltre rimborsare l’imposta di registro per lo scioglimento del Contratto. Qualora il Cliente non rispetti il termine di preavviso, verserà in ogni caso la Quota Alloggio, come definita nel Contratto, per il periodo di preavviso non rispettato. L’Host potrà soddisfare il suo credito per le penali trattenendo il relativo importo dal deposito cauzionale. Nel caso in cui il deposito cauzionale non sia sufficiente chiederà il pagamento dei maggiori importi al Cliente, che dovrà provvedere entro 15 (quindici) giorni. Withdrawal and penalties The Client has the right to withdraw from the Contract by written notice to be sent by registered letter with return receipt with the notice provided according to the duration of the Contract: (a) at least 180 (one hundred and eighty) days before the release of the Accommodation, for annual Contracts; (b) at least 90 (ninety) days before the release of the Accommodation, for Contracts of duration greater than or equal to six months; (c) at least 30 (thirty) days for Contracts of duration less than six months. In case of withdrawal, the Customer will pay a penalty for early withdrawal. The amount of the penalty is determined as follows: (i) for stays of less than 7 (seven) months, the penalty is equal to one monthly installment of the Accommodation Fee as defined in the Contract; (ii) for stays of more than 7 (seven) months, the penalty is equal to two monthly installments of the Accommodation Fee, as defined in the Contract. The Customer shall also reimburse for the registration fee for the termination of the Contract. The amount of the penalty is considered adequate by the Parties, therefore irreducible, due to the interest in the correct application of the rate on the basis of the real intentions of staying in the Customer's Residence, as well as due to the peculiarity of the market of university residences with regard to the limited period of time in which the demand for housing is concentrated. If the Customer fails to comply with the notice period it will in any case pay the Accommodation Fee, as defined in the Contract, for the unfulfilled notice period. The Host will be able to satisfy its credit for the penalties by withholding the related amount from the security deposit. In the event that the security deposit is not sufficient, it will ask for the payment of the remaining amounts to the Customer, who must provide CampusX with the payment within 15 (fifteen) days.
