🏠 Exclusivity
The landlord, depending on the selected package, may or may not have exclusivity. The exclusivity option is linked to the chosen package and the duration is defined within it.
● Definition and Obligations:
o With Exclusivity, the landlord undertakes to publish the listing only on Spacest.com for the entire duration of the agreed period.
o The property may not be promoted either through other websites (by way of example but not limited to: Airbnb, Booking, Idealista, Subito, etc.), nor through other online or digital promotion methods.
o In case of direct contacts received by the landlord during the Exclusivity period, the negotiation must obligatorily pass through Spacest.com, so that the rental is concluded through the platform and the related services are guaranteed.
● Activation: Exclusivity is activated from the moment the listing is published online, that is, at the end of the uploading and approval process by the Spacest.com Team. From that instant the exclusivity period begins.
● Monitoring: The landlord can check at any time the end date of the exclusivity from their personal desk and directly on the listing page.
● Renting during exclusivity: If the listing is rented during the exclusivity period, it is suspended and automatically resumes from the day the property becomes available again.
● Termination: The landlord has the right to terminate the exclusivity at any time by notifying the Spacest.com Team directly, which will proceed with closing the exclusivity (30 days’ notice for termination).
● Penalty in case of violation: If the landlord does not comply with the obligations provided for by the Exclusivity (publication on other channels, direct conclusion without Spacest.com, promotion through other online means), they will be required to pay Spacest.com a penalty equal to one monthly rent (excluding VAT) of the property subject to rental.
● Practical example:
1. Listing published on September 1st → exclusivity valid until September 30th (30 days).
2. The apartment is rented from September 30th to July 1st.
3. Upon new availability (from July 1st), exclusivity automatically restarts and will remain valid until July 31st.
🔐 Rent Protection
● Scope of coverage:
o Spacest.com/Partner covers up to 12 months of rent and ancillary charges in case of non-payment by the tenant.
o Months that the Landlord has already compensated with the security deposit are excluded.
● Requirements for activation of coverage:
o Spacest.com/Partner may refuse or interrupt the service if:
▪ The Tenant is different from the one analyzed.
▪ The information provided is incomplete, incorrect, or untrue.
▪ The Landlord carries out actions/omissions that compromise payments.
● Procedure in case of arrears:
o Spacest.com/Partner advances the rent to the Landlord without waiting for payment from the Tenant.
o If the tenant becomes delinquent, the Landlord automatically assigns the credit to Spacest.com/Partner for all payments made by Spacest.com/Partner to the Landlord.
o Spacest.com/Partner offers out-of-court and/or judicial assistance for credit recovery. For this purpose, the Landlord grants a mandate to Spacest.com/Partner to:
▪ Act in the name and on behalf of the Landlord.
▪ Report the tenant to Credit Information Systems.
o The Landlord undertakes to follow the instructions of Spacest.com/Partner and manage the security deposit according to the instructions received.
In the event of the need to proceed with the eviction of the Tenant, Spacest will fully assume the management of the legal procedure, taking care of all necessary obligations in the name and on behalf of the Landlord, including the appointment of lawyers and the assumption of all costs connected to the procedure.
During the entire duration of the eviction procedure, Spacest will continue to guarantee the Landlord the payment of the agreed rental fees, within the limits of the expected coverage (maximum 12 total monthly payments).
By way of example, if a rental contract runs from January 1st to December 31st and the eviction request is initiated in the month of March, Spacest will still pay the Landlord the rent from March to December, even in the event that the Tenant does not vacate the property spontaneously.
💰 Monthly rent Management
● Collection method:
o The Landlord grants an irrevocable mandate to Spacest.com/Partner to collect the rents and transfer them to their account.
● Payment schedule: The rent is credited on the following dates:
o On the 15th of the month, if the contract starts between the 1st and the 14th of the month.
o On the last day of the month, if the contract starts from the 15th onwards.
💥 Damage Protection
● Maximum coverage:
o Damage Protection reimburses the Landlord up to a maximum of three months’ rent (including VAT) established in the aforementioned contract, if the tenant refuses to compensate for damages.
In any case, reimbursement may not exceed the total amount of €15,000 (including VAT).
● Damage Protection is activated when:
o At the time of release of the property, damages are found due to the tenant’s failure to properly maintain the premises.
o The security deposit paid by the tenant is not sufficient to cover the entire compensation requested.
o The Tenant refuses to pay, in whole or in part, the amount due for the verified damages.
● Minimum amount:
o In order to submit a reimbursement request to Spacest.com/Partner, the amount of the single damage must exceed €100 (including VAT).
● What does Damage Protection cover?:
o Material damage to the accommodation and furnishings (e.g. furniture, appliances) caused by the Tenant or their guests.
● What does Damage Protection not cover?:
o Normal Wear and Tear: The natural deterioration of the property due to time and normal use.
o Natural Events: Damage caused by earthquakes, floods, storms, etc.
o Theft or Loss of Currency, Works of Art, Jewelry.
o Cleaning: Costs for ordinary cleaning at the end of the lease (e.g. laundry washing, dishwashing, garbage removal).
o Damages exceeding the Maximum Coverage: Any damage, even if covered in principle, that involves compensation exceeding the maximum limit provided by Damage Protection.
Procedure to Request Reimbursement:
